Abstract

This research exposes the legitimacy that a citizen acquires in a representative public office in an indigenous municipality. When, the citizen is reinstated to public office as a result of a ruling of the Electoral Court of the Federal Judicial Branch. The events in the Municipality of Chenalhó, Chiapas, are taken as a point of reference, where the municipal president was reincorporated after It was proven that political rights were infringe due to gender-based political violence. This sets a precedent that opens a debate between the electoral judicial authority`s intercultural discourse, and the right to self-determination of indigenous people. The legislation is force to processes internal legitimation in electoral matters of indigenous people.
