This study deals with a first encoder trial in Mexico. The Law of 5 January 1857 common elements gave judges to impose sentences and penalties as contained elements such as criminal and civil liability; a catalog of aggravating circumstances, mitigating or exculpatory, and includes the prison in the catalog of existing penalties. Elements that facilitated the delivery of justice in the forums, contributing to degrade the basis on which the right of Old Regime was based as judicial discretion.
