Abstract

This paper raises the question of the foundation of Human Rights and the way in which we may be able to talk about them in terms that neither iusnaturalism or iuspositivism seem to be able to, beyond the opposition between their self evidence or their imposition. In this context, an appeal to the values appears as an alternative to argue human dignity and Human Rights. In this direction, the author stablishes a dialogue with Luis Neil on which it may be the role of phenomenology in the universal foundation of Human Rights. Therefore, he shows how the works of Edith Stein and Adolf Reinach can help us to follow Niel’s reflections on the priority of human dignity before Right, as he does following Husserl’s philosophy.
