Abstract

The constitutional changes that established access to water and sanitation as a human right require a review of the legal frameworks and public policies pertaining to water, which is still pending. This article reviews the legislative history of water allocations and concessions, as well as current policies related to drinking water and sanitation services. The results demonstrate that they lead to unequal access to economic resources on the part of the municipalities, and therefore non-compliance with the human right to water. A systemic model is proposed to describe the problem and recommend steps to resolve it.
