If femicide is understood as the deprivation of women's lives based on gender, then it seems valid to ask; in femicide are trans women considered the passive subjects or victims when they are deprived of life by gender reasons? To attend this matter properly, women's rights must be placed at the center of analysis in order to identify the cases of murder of trans women for gender reasons when the aggressions are directed towards a feminized body exposed to unequal roles versus what is recognized and known as masculine. For this reason it must be analyzed if life deprivation of trans women is observed in femicide or it is necessary to create a special penal law to protect them from sex-based hate crimes. Understanding that the criminal norm is established as a means of social control in the protection of the basic rights for each society at the same time that from its normative sphere it allows visualizing realities that must be addressed in an intersectional way as is the deprivation of the life of trans women as a result of the feminicidal violence to which they are systematically exposed.
