Abstract

The article provides an overview of the evolution and consolidation of environmental law in Mexico, in perspective with international law. On the one hand, it shows how in a few years, the Mexican constitutional regulation has been strengthened and has reached the standards of other Latin American countries. On the other hand, it reviews legal features of national and international court resolutions that show a “greening” of the courts. Expressly, a set of jurisdictional assessments that are highly favorable for the protection of the environment, as well as for the protection of the human right to a healthy environment. Following this trend, the article reflects on the vulnerability of indigenous communities and the larger society and identifies -as part of the challenges for evolving jurisdictional trends- the expansion of the perspective of vulnerability, and the conception of a universal interest.
