The article analyzes the values argument use in the Mexican case law as an argumentative resource in the decisions. Through an interpretive study, a conceptual reconstruction is proposed that allows identifying the presence of two main perspectives in the judicial criteria. According to the first, values are an extraordinary argumentative resource of exceptional use in decisions. For the second, values are an ordinary argumentative resource that must be taken into account in most decisions. From this reconstruction, clarifying the use of values in case law is proposed based on the thesis that there are no values within the law. There are solely norms that order the construction or preservation in social life of a certain good or object, which is appreciated as valuable in a deliberation.
