This article primarily provides some theoretical considerations on constitutional guarantees from the point of view that some important authors have on the subject, then it focuses on the evolutionary treatment of this resource in the constitutional laws of Guatemala from the Constitution of 1921 (that introduced it), then the 1965 and currently the 1985 Constitution with the reform of 1995 that contemplates it.
