This paper analyzes some state non-compliance -and in particular with regard to Spain- of the directive on the collection and treatment of urban wastewater. In this sense, the judgment of the Court of Justice of the European Union (CJEU) of July 25, 2018 (case C-205/17) is emblematic, which establishes the breach by Spain of said directive, as well as the imposition of pecuniary sanctions in this regard, for failing to comply with a previous ruling on the same issue. This judgment has been relevant for Spain due to the number of municipalities affected, as well as the amount of the fine imposed, and constitutes an ideal framework for analyzing various cases in which the CJEU has offered similar solutions. This is an unprecedented challenge, both for Spain and for the European Union (EU), in an attempt to meet commitments related to the environment.
