Participatory democracy and, especially environmental democracy, have as one of their pillars the rights of citizen participation, which enjoys extraordinary relevance in the context of the development of projects that affect the subsoil and non-renewable natural resources. Hence, by constitutional imperative, adequate, suitable and effective participation mechanisms -such as public consultation- must be fully regulated by law, so that all people can exercise their fundamental rights and demonstrate - individually or collectively-, inclusive of the channels offered by representative democracy, the opinion that certain environmental projects deserve. This, in addition, supposes harmonizing the exercise of the competences between the nation and the territorial entities so that, in application of the principles of concurrence and coordination, the effective exercise of fundamental rights and the use of natural resources are guaranteed, under the aegis of sustainable development.
