This paper reflects on the declaration of the Moorland of Pisba (Boyacá, Colombia), as a subject of rights and its relationship to the violation of the rights of citizen participation of the inhabitants of the area. Faced with the need to protect the country’s moorlands and the effects that may result from the collective and fundamental rights of the inhabitants of the moorland areas, Colombian jurisprudence has established different rules to guarantee the right to citizen participation as a fundamental component of environmental justice. In the case presented, in addition to guaranteeing the aforementioned right, it was considered necessary to recognize the ecosystem as a subject with its own rights, which has specific legal implications. The work also presents reflections on the relationship of this recent trend in the country with environmental justice and its derived rights: information, participation, and access to environmental justice.
