COVID-19 is a disease with high rates of spread and mortality that has led to the worldwide establishment by governments of measures that limit the exercise of fundamental rights, especially the right to autonomous work in public spaces. The Autonomous Decentralized Government (GAD) Machala, which as a mechanism to guarantee the right to health in the face of the COVID-19 pandemic, promulgated a municipal ordinance that restricts the right, and in the face of this, the questions arise: do the administrative decisions of the institution should focus solely on guaranteeing the right to health? How should the municipal administration of Machala deal with the consequences of the COVID-19 pandemic on the right to work?
