PENA SANCHEZ, Edith Yesenia y FLORES RAMIREZ, Víctor Hugo. Trans childhood and human rights. An evolving legal-anthropological paradigm in Mexico. Cuicuilco. Rev. cienc. antropol. [online]. 2022, vol.29, n.83, pp.131-160. Epub 10-Oct-2022. ISSN 2448-8488.
Trans minors claim for themselves the right to a “self-perceived” gender identity [SCJN 2019] in terms of legal recognition and free development of their personality, exempt from pathologization by medical science and with the support of social disciplines such as law and anthropology. Hence, the objective of this communication is to provide an overview of the last five years in which trans children in Mexico have gained visibility from the paradigmatic cases and joint legislative work with organized civil society. In order to position the issue at the debate table on the biomedical and legal construction of transsexuality in childhood, since it presents edges that are the object of legal-anthropological analysis that contribute to understand the generation of new paradigms in human rights and reflect about its construction.
