The triggering mechanisms of the ICC are determined in the Rome Statute; nevertheless, in case of proprio motu investigations, the Office of the Prosecutor have very discretional powers to establish parameters to open [or not] an investigation in the ICC. This paper tries to determine which factors have to be considered, explaining the decisions that need judicial control and examining if this prosecutorial politics are consistent with the judicial practice at ICC, the Rome Statute and internationally recognized human rights.
