The political and moral philosophy happens to be discussed in more depth in the analysis of the constitutional law after World War II and, therefore, it is necessary to revisit the legal forms hitherto consecrated by the canons of law. If this element of the constitutional philosophy is evident in contemporary Brazilian constitutionalism, legal decisions that are produced here, as well as those relating to human rights at the international level, are not always the same paradigm musings direct. To be able to identify this observation, the objective of this work is to analyze the judgment in Case Ximenes Lopes against Brazil, issued by the Inter-American Court of Human Rights of the OAS.
