This article proposes to discuss whether it is possible to protect economic, social and cultural rights by applying the principle of non-refoulement as from the International Covenant on Economic, Social, and Cultural Rights (ICESCR). For that, we will analyze the formation of the non-refoulement obligation as a general human rights norm from the regional mechanisms for the protection of human rights and the characteristics of this norm. After that, we will evaluate whether an obligation of non-refoulement in these same terms can be derived from the ICESCR, considering the relationship between civil and political rights and economic, social, and cultural rights, and the obligations of cooperation and of immediate realization of rights contained in the Covenant.
