PORTILLA GOMEZ, Juan Manuel. The Imprecise Legal Regulation of Secession Processes in Postcolonial International Law. The Case of Catalonia. Anu. Mex. Der. Inter [online]. 2019, vol.19, pp.81-114. Epub 11-Mayo-2020. ISSN 1870-4654. https://doi.org/10.22201/iij.24487872e.2019.19.13319.
Postcolonial secession is one of the most debated issues in international law. The self-determination of peoples versus the territorial integrity of States and the unilaterality of a declaration of independence versus non-consent of the State are irreconcilable. Likewise recognition becomes an external element that has an important impact on these processes. The case of Catalonia demonstrates an excessive neutrality of international law and exhibits a scenario with an absence of clear rules that propitiate the weakening of international law in the face of realpolitik.
