This article examines the importance of the work of the International Law Commission in the development of the concept of jus cogens, which began with its inclusion in articles 53 and 64 of the Vienna Convention on the Law of Treaties. Furthermore, the Commission, based on an analysis of international practice, has defined, in four different reports, the nature of jus cogens, the requirements to endorse an international norm as such, its legal consequences, and an illustrative list of these statutes. In this way, the International Law Commission has made useful contributions to the progressive development of Public International Law.
