BOZA PRO, Guillermo y BRIONES ZEGARRA, Joaquín. Time to disconnect: reflections on a “new” right with old content. Rev. latinoam. derecho soc [online]. 2023, n.37, pp.91-144. Epub 12-Ene-2024. ISSN 2448-7899. https://doi.org/10.22201/iij.24487899e.2023.37.18541.
This article addresses a relatively “new” topic that, with regard to the rapid development of ICT and the increase of remote work due to the COVID-19 pandemic, has risen intense debates and questions in the world of work: digital disconnection. For this purpose, the authors have divided their research into two sections. Firstly, they take a general approach, based on comparative experience and the corresponding doctrinal development, the content of this right, its legal nature, and the controversial debate on the need for its autonomous regulation. Secondly, digital disconnection is analyzed in terms of the regulations that have historically governed working and rest time in Peru. Finally, the conclusions of this research are presented.
