This text deals with some of the indicators of the legal process promoted in Mexico under the pressure of indigenous demand, accelerated by the Zapatista uprising which put the issue on the national agenda. The legal and constitutional aspects of the regulatory process are highlighted, with special emphasis on today now that the regulation of natural resources has become relevant, with the resulting impact on the possibility of achieving the reconstruction of indigenous peoples along the lines of autonomy but also within the framework of a real and profound State reform. Firstly the article undertakes a general reconstruction of the stages of the legal process, including the reforms of 1992 and 2001. It presents a reflection on ILO-Convention no. 169 and the right to consultation. Finally, the article notes elements of the reasons of State that were imposed against indigenous demands, as well as their implications, especially when it comes to defining the end of a period which will continue as long as the neo-liberal hegemony survives.
