The objective of this study is to question the provisions contained in the Chilean Law on Migration (Law No. 21.325, of April 20, 2021) from a human rights approach to migrant children and adolescents. The aforementioned piece of Law, despite containing as one of its inspiring principles the best interest of the child, however it does not seem to be able to offer clear answers in accordance with the real needs that foreign minors need, very particularly those who are unaccompanied or separated from their family references.
