Based on the observation of initial hearings in criminal courts in Mexico City and on interviews with legal practitioners, this article describes the control of police arrests from two perspectives: 1) how prosecutors narrate the detentions, and 2) how judges’ responses vary according to the type of crime. The results show that decisions are made based on typified narratives, prepared to comply with the hypothesis of flagrancy, and that the decision of illegality depends on errors in those narratives and on extra-legal factors such as the gravity of the criminal types.
