Resumen

BATISTA, Fernando. Human dignity: between universality and cultural diversity. Bol. Mex. Der. Comp. [online]. 2023, vol.56, n.167, pp.33-50.  Epub 25-Jun-2024. ISSN 2448-4873.  https://doi.org/10.22201/iij.24484873e.2023.167.18535.

The current multiculturalist phenomenon has raised a relevant debate in the field of study of human rights: their universality vis-a-vis cultural diversity. The main purpose of this paper is to reflect from an ius-philosophical perspective on how to reconcile these aspects in the light of human dignity. To this end, it analyzes the basis of the universality of human rights in order to determine that these are not mere cultural constructions. It delves into the study of human dignity and cultural identity in order to establish that the protection of identities is a human right stemming from it. Additionally, it dissects the various implications that derive from their reconciliation. Ultimately, it is concluded that it is not only feasible, but also indispensable to reconcile the universality of rights and cultural diversity to enable dialogue between cultures and increase the solidarity associated with human rights.
