Once Argentina’s democracy was restored, the question of the university budget has been a central issue in the debate of public policies and for some governments it was a tool to “impose” University initiatives and policies decided by the Executive. Both doctrine and jurisprudence have held that the university autonomy objective, which the Constitution expressly recognizes in article 75 inc. 19, is to disassociate the university from its dependence on the Executive, but not from the regulatory power of the Legislature. Within the framework of the Argentine legal system, university autonomy is presented not only as a form of an allocation of competences but is a real guarantee against the National Executive Power whereby Congress must enact a law on autonomy of national universities. In this article, we make a proposal to build an institutional legal instrument by which the National Congress and the Universities themselves emerge at the center of the process of defining the university budget, exercising the powers and power that the constitution recognizes.
