The State's obligation to provide security for the governed is a fundamental piece within the principles of a democratic constitutional state, which must serve to a full respect of the fundamental rights of those who should be its primary backup object. This involves the designing of a criminal policy aligned to protectionist standards adopted by the constitutional reforms of 2008 and 2011. However, only the government ministers authorized to participate in public security functions shall have by law the faculty to intervene operationally, because if not, there could exist violations to the legal sphere of the governed.
