This paper analyzes the relation between the Oaxacan political economy and the norms of the State that recognize indigenous towns and native communities rights. From a critical position, this work shows that the present scheme of recognition goes a step behind in regards to the contemporary social dynamics, since the legal reform proposes the formalization of the anachronistic relation between native communities of Oaxaca and the State government, which was configured along the 20th century in the frame of rural economy. Thus, this work deals with some of the challenges for the local judicial system and the institutions responsible for administering justice within native communities in the globalization period.
