The elaboration of a Constitution is something more than arrangement of powers. With this fundamental premise, the author considers that the communitarian institutions, economic Europe and the survival of the social model are in transition. Throughout the text, the author analyzes diverse aspects of the economic Constitution, specially the expression “social economy of a highly competitive market”, reaching the conclusion that the idea of balance between social and the economic thing became denaturalized with the introduction of the competition, which along with the communitarian competition in economic matter influenced by the integration exigencies, make suppose the author who the opportunity to contribute a model of rational policy based on the social and economic democracy as counterpoint to the globalization based on the spontaneity of the market were failed.
