This is a critical analysis of the resolution adopted by the Supreme Court of Justice of the Nation in the action of unconstitutionality 113/2018 in which it declares the invalidity of the normative portion of article 420 of the Civil Code of the State of Jalisco that conditions ex-spouses to wait a year to contract new marriages. It analyses how the constitutional resolution protects the fundamental right to the free development of personality and transforms the local legal structure in matters of divorce.
