The objective of the text is to analyze properties, characteristics and elements that define the indigenous communities of San Luis Potosi and discuss the relationships between language, people and community, territory, territoriality and extraterritoriality, de facto and de jure communities. The result of the analysis lead to distinguish the indigenous community by: a community assembly, the use of the indigenous language, uses and customs and the enjoyment of the festival. The work, refers to the dual composition of the community concept: a physical objectification confronted with the identity that configures an elusive and subjective reality. The text calls for the recognition of the constituent elements of the indigenous community to facilitate access to their rights, particularly the right to consultation. The conclusions are aimed at recognizing the importance of the assembly as a defining element of the indigenous community for the resolution of any internal or external problem.
