The definition of economic crime, its relation with the white-collar crime, as well as factors that generate economic delinquency and the characteristics of those who break the law to the detriment of the economy, are perennial themes in the modern criminological and law agenda. The debate on the most effective means of struggle to minimize this scourge does not stop. At present, when the repressive general option and the catalogs of penalties established by the modern Penal Codes do not appear effective to face up to the economic crime, criminology proposes possible solutions in that regard, which, without to deny the importance of the penalty, emphasize prophylactic measures. This article analyses these elements.
