Resumen

OCHOA GAVALDON, Roberto Xavier. Crime, Punishment, Forgiveness and Peace, in the Light of the Western Juridical Tradition. Rev. filos.open insight [online]. 2018, vol.9, n.15, pp.111-124. ISSN 2395-8936.  https://doi.org/10.23924/oi.v9n15a2018.pp111-124.20.

Ultimately, it is a task of mystics to speak of hope, forgiveness or reconciliation. Such acts of language demand an anagogical interpretation. Nevertheless, Hugo of Saint Victor showed that there is no other access to the anagogical interpretation than the training of interpretation by analogy, which supposes having made the way through the path of literal interpretation. This paper claims that it is necessary to walk through the painful path of the literal interpretation of justice in History before speaking of the horizons of reconciliation and forgiveness, for crime or peace are, first and foremost, happenings in concrete History. Therefore, the trajectory, barely described here, begins by tracing the peculiar situation in which citizens in the West find themselves before the monopoly of the force by the Modern State, expropriated of capabilities such as the indignation before the outrageous. This loss makes the horizon of forgiveness unattainable if it makes us unable to regain the human horizon of what is fair, for there is no peace with dignity without memory and justice.
