The objective of this article is to evident the importance of the cultural legacy of the “ethnic groups” and their capacity to exercise patrimonial rights; methodological support is the study of the legal background of minorities in terms of equity and equality. Popular cultures are affected in their rights over literary, artistic, artisan works, etc. of those who are holders as custodians and carriers of cultural heritage, they constitute a type of citizen in conditions of vulnerability, both in terms of their tangible heritage assets and those of intangible order such as uses and customs.
The federal copyright law does not apply a patrimonial type of coverage that grants real powers in the defense, protection and development of such cultural property. For which it is necessary to generate an initiative to promote the granting of such rights in the Federal Copyright Law.
