Resumen

RAMIREZ BANUELOS, Jesús Francisco. The treaty between mexico, the united states and canada as a complementary instrument to the paris agreement in the fight against climate change. Derecho glob. Estud. sobre derecho justicia [online]. 2022, vol.7, n.20, pp.49-75.  Epub 25-Abr-2022. ISSN 2448-5136.  https://doi.org/10.32870/dgedj.v7i20.362.

This article aims to show that the Paris Agreement is not the only source of U.S. international obligations on climate change. It is argued that the Treaty between Mexico, the United States and Canada (USMCA) postulates a maximum protection claim that includes climate change. To this end, the doctrine of binding multilateralism is mobilized. First, the nature of the executive decisions of the presidents of the United States is studied. It then identifies the international obligations adopted by the United States with the entry into force of the T-MEC. It concludes that the T-MEC is a complementary instrument in the US policy to combat climate change.

Palabras llave : Paris Agreement; USMCA; climate change; multilateral environmental treaties; mandatory multilateralism.
