The purpose of the State responsibility is to improve the activities that are carried out by public bodies, in defense of the rights of the governed; however, in practice, better provision of state services has not been achieved, but damages to the governed continue to be caused, including on many occasions with deliberate actions. Given this position, the present work seeks to determine whether it would be possible to incorporate a figure such as punitive damages in the activity of the State, and thus avoid future damages.
