Resumen

CHINCHILLA FUENTES, Luis Ovidio. The next step in the legal personality of companies: Companies as Citizens. Derecho glob. Estud. sobre derecho justicia [online]. 2023, vol.8, n.23, pp.185-223.  Epub 05-Mayo-2023. ISSN 2448-5136.  https://doi.org/10.32870/dgedj.v8i23.565.

This article aims-through a historical, philosophical, and dogmatic analysis-to provide compelling arguments to evolve the concept of corporate legal personality to that of corporate citizenship. By focusing on Anglo-Saxon corporate law, this work shows how citizenship counterbalance corporations’ impacts vis-a-vis human rights by rooting them in a jurisdiction. This article provides innovative solutions regarding corporate abuses against the human rights of the communities where they operate. The concept of corporate citizenship proposed entails more comprehensive moral duties towards fellow citizens at the local, regional, and global levels. Corporate citizenship advocates for creating national and supranational legal governance frameworks that recalibrates the rights and responsibilities of companies through the model of citizenship. In short, this work is a critique of the current statu quo of companies as legal entities.

Palabras llave : Citizenship; legal personality; businesses; and human rights..
