This article presents the jurisprudential elements used by the Supreme Court and the Tribunal for the Defense of Free Competition to assess the merit of the divulgence and background information provided by a colluding company when requesting the benefit of compensated delation. In this regards, critical arguments are made regarding these elements considering the organic and functional configuration of the free competition system in Chile, given the need to reduce the requirements for the conferring of evidential value to the denouncements.
