This paper studies the case of a Wichí girl raped by her stepfather in an indigenous community in northern Argentina. It begins by analyzing the arguments put forward by the Court of Salta to waive the proceedings against the accused, and thereby the existing conflict between the individual rights of women and girls, and the collective rights to self-determination of indigenous peoples. An exercise is subsequently conducted to identify the vulnerable group to which the Wichí indigenous girl-woman belongs from an intersectional perspective that shows how, in a case like this, formal equality does not suffice to address problems that are a consequence of structural oppression.
