In spite of the differences concerning marriage between the Western and Muslim legal traditions, both coincide in that they consider that this is a key institution which, as such, deserves special legal protection. However, beyond this common conception, there are notable differences in the rules that govern this institution in both legal traditions. This creates problems in countries which, as today Spain, are recipients of large groups of Muslim population. In the human, cultural and legal encounter caused by immigration, Private International Law has a relevant role to play as a branch of the law that helps to solve multiple controversies which spring out in multi-cultural societies. In this way, the goal of this article is, in the context of the 10 years of the Law 26/1992, to develop a reflection on Muslim marriages in Spain.
