After the processes of political transition that have been experienced by several countries, in recent years a discussion has emerged around the relationship between reconciliation and criminal responsibility: what in English has been called "transitional justice". Since 1989, many efforts have been made to balance and to legitimize the different ways to treat the violence sponsored by the State and perpetrated before a change in the status quo of political power in a given society. In this essay, the different possibilities implied in this debate are examined, including the perspective changes with respect to the paradigme of impunity that has emerged in recent years.
