The theoretical foundation of fascism is used in a very subtle way within today's Italian civil law. In turn, this situation shows the communion that has existed since the formation of this ideological movement with the juridical liberalism. In this essay, the author argues that there is a common terrain shared by juridical liberalism and fascism. In particular, he refers to the compatibility between fascism and economic liberalism, as well as to the critique of fascism and liberalism directed to the principle of separation of powers.
