Resumen

ZAMBRANO, Pilar. Antipaternalismo y antiperfeccionismo en John Rawls y Ronald Dworkin. Bol. Mex. Der. Comp. [online]. 2005, vol.38, n.113, pp.869-887. ISSN 2448-4873.

In this article, the author studies the most important characteristics of anti-paternalism and antiperfeccionism as understood by two representatives of contemporary political liberalism: Rawls and Dworkin To liberalism, antipaternalism constitutes one possible necessary consequence of antiperfectionism or the independence from governamental action with respect to disputed notions of moral good. Rawls is positioned in the antiperfectionist field due to his definition of justice, from which he derives the existence of a list of fundamental liberties, related to the general good. For its part, Dworkin seeks to construe a liberal ethics in order to provide the foundations of a liberal political system. The author concludes that antiperfectionism, rather than giving support to antipaternalism, contributes to empty it of content.

Palabras llave : political liberalism; fundamental rights; ethics; hierarchy of rights; concurrence of rights.
