Resumen

ROJAS AMANDI, Víctor Manuel. La Uniform Electronic Transactions Act de los Estados Unidos de América. Bol. Mex. Der. Comp. [online]. 2007, vol.40, n.119, pp.531-584. ISSN 2448-4873.

The Uniform Electronic Transactions Act (UETA), one of the several United Status Uniform Acts proposed by the National Conference of Commissioners on Uniform State Laws and adopted by in 1999, is a uniform statute that provides a legal framework for electronic transactions. The UETA essentially puts electronic transactions on the same par as paper transactions. The UETA is built on these three premises: 1) That most state law requirements for a writing can be satisfied by an electronic record, 2) That most state law requirements for a signature can be satisfied by an electronic signature, 3) In most cases, parties should be able to agree to any form of electronic communication defined by the contract. This article tries to answer following questions: What is an electronic document?, What factors should be considered to determine if an electronic signature is appropiate?, Does an electronic document may be admitted to the court?.

Palabras llave : Electronic contracting; electronic trade; electronic signature; The United States; uniform laws.
