This article is about the rule of action, reading by the Brazilian Federal Constitution. It proposes a new theory for the rule of action, conceiving as a fundamental right, which must be the base for the under constitution legislator to allow the material right's effective tutelage. The insufficient legal protection of the fundamental right of rule of law obliges the judge to supply legal proceedings technique's miss in the concrete case, because your duty of provides the fundamental right of rule of law's protection and gives the effective jurisdictional tutelage for all the situations of substantial rights.
