The controversial nature that presents the so called "religious question" in Spain demand a reconsideration of its normative foundations in the existing Constitution. Therefore, the present paper examines the institutional dimension that incorporates the fundamental right of religious freedom. Indeed, it acts as the supreme prineiple inspiring all the public activities related to the subject. Besides, it' is also important to deiermine the significance and the extension of the constitutional principle of laicism, not only as hisiorieal expression of the separation that must exist beiween the State and the churches, but also as a priniiple that restricts the decisions promoted by the public institutions trying to optimize the religious freedom. Finally, this paper makes a critical com i meniary about the real application of the concordats signed with the Catholic Church and the agreement signed with the minority confisi sions in Spain. At the end, it's expressed, as a conclusion, an assessment of the present situation and some proposals to correct it.
