NOSEDA, Paula. International, Regional and South American Legal Analysis of the Fire Policy Managment in the Ecosystems. Bol. Mex. Der. Comp. [online]. 2011, vol.44, n.130, pp.135-169. ISSN 2448-4873.
This paper is written based on the need to design a global response with regional adaptations to the fire policy incidence on the ecosystems. In that way, we elaborate on this matter in the legal international community context, giving special emphasis in the advances reached by the South American region. First of all, considering the binding international legal instruments we noted the lack of prevision on general fire policy management however, we noticed sole focus on certain aspects of contamination which were provoked by wildland fire. Furthermore, we have analyzed non-binding international legal instruments such as treaties as well as soft law, like declarations and recommendations, which were developed in different international seminars and serve as guidance, also based on general principles, to those who make decisions. Moreover, we have studied the fire policy management in South America which pursuits the cooperation among the countries in the region.
