NASH ROJAS, Claudio  y  NUNEZ DONALD, Constanza. Formal and Substantive Reception of International Human Rights Law: Comparative Experiences and Chilean Case. Bol. Mex. Der. Comp. [online]. 2017, vol.50, n.148, pp.185-231. ISSN 2448-4873.

This article analyzes the substantive and formal reception of international law of human rights in Latin America (Argentina, Colombia, Costa Rica, Chile, México y Perú), in order to demonstrate that although constitutional formal reception options have been different, the constitutional jurisprudence has followed paths that converge towards a substantive reception of this. This jurisprudential reception tends towards greater effectiveness in protecting human rights, in order to comply with international obligations assumed by States, through the use of common tools: constitutionality block and pro homine principle.

Palabras llave : Human rights; constitutional justice; international law; constitutionality block; pro homine.
