DIAZ, Julio Alberto. Intentional offenses under Common Law. Bol. Mex. Der. Comp. [online]. 2018, vol.51, n.152, pp.505-536. Epub 30-Abr-2020. ISSN 2448-4873. https://doi.org/10.22201/iij.24484873e.2018.152.12916.
Intention in extra-contractual civil liability under common law occupies a more prominent place than it does in codified systems. In such systems, harm is the most relevant component where, in the vast majority of cases, there is scant regard whether it was caused intentionally or not. On the contrary, under common law, the presence of intent leads to an important category: trespass. In this work we attempt to focus our attention on the four intentional unlawful acts that exist against people: battery, assault, false imprisonment and psychological damage provocation (infliction of mental distress).
