This paper argues that criminal populism has been interpreted and characterized in many ways, but no proposals have been made to establish a “threshold” to define when a criminal reform is legitimate and necessary, or when it is populist or reactionary. This paper proposes a model applied to penal reforms that could be considered populist, and thus, offer a test that allows to take a step towards the theory of criminal populism.
