ISLER SOTO, Carlos Augusto. What Role Does The Consideration Play in Thomas Hobbes's Contract Theory?. Bol. Mex. Der. Comp. [online]. 2019, vol.52, n.156, pp.1523-1550. Epub 23-Mar-2021. ISSN 2448-4873. https://doi.org/10.22201/iij.24484873e.2019.156.15161.
The doctrine of consideration as an element in every contract according to Thomas Hobbes has not received enough attention by scholars, and the few who have commented it, have erred in regard to its function. In this paper we expose the role this notion plays in his theory of contract; in what sense it is necessitated by Hobbesian anthropology, and in what measure it is simply an import from Common Law; which types of consideration Hobbes can accept, and we treat on the possibility that, at the end of his life, Hobbes may have replaced it with the civil law notion of causa. We analyze the consideration in the social contract as well.
