The legal regime of bilateral investment treaties (BIT) is suffering a deep structural crisis. In this context, many countries have decided to renegotiate or to denounce their BITs. Others have gone further and have adopted already new BIT models. Mexico is not taking part in the debates surrounding this global crisis of the investment protection regime in international law. Additionally, some recent governmental decisions are transforming Mexico in a, de facto, promoter of the consolidation of the current legal and institutional design of BITs. However, it is urgent to modify Mexico´s foreign policy in this area and, in this sense, to adopt a new BIT model for our country.
